STEPHEN EDWARD ROGERS v. Comm'n for Lawyer Discipline

On January 16, 2004, the Board of Disciplinary Appeals dismissed for want of prosecution the appeal of Lincoln, Nebraska attorney Stephen Edward Rogers, 52, SBOT Card No. 17186400, of a judgment of disbarment issued by the Evidentiary Panel for the State Bar of Texas District 01A grievance committee. The Board found that Rogers did not file a brief. The Board issued an Order to Show Cause to Rogers on October 30, 2003, giving him 30 days to respond and show cause as to why this appeal should not be dismissed for want of prosecution. Rogers filed a Motion to Reconsider and for Rehearing on January 22, 2004. The motion was denied on February 4, 2004. Rogers filed a Second Motion to Reconsider En Banc on February 17, 2004. On March 29, 2004 BODA denied the Second Motion to Reconsider En Banc. Rogers appealed the decision to the Supreme Court of Texas - case no. 04-0381. On July 23, 2004, the Supreme Court affirmed the decision of the Board of Disciplinary Appeals.
