DAVID M. TOWNSEND v. Comm'n for Lawyer Discipline

On January 16, 2004, the Board of Disciplinary Appeals dismissed for want of prosecution the appeal of Houston attorney David M. Townsend, 57, SBOT Card No. 20169500, of a judgment of partially probated suspension issued by the Evidentiary Panel for the State Bar of Texas District 04A grievance committee in Case Nos. H0029714777 and H0089613533. The Board found that Townsend did not file a reporter's record or a brief. The Board issued an Order to Show Cause to Townsend on October 30, 2003, giving him 30 days to respond and show cause as to why this appeal should not be dismissed for want of prosecution. Townsend did not respond. On March 8, 2004, Townsend appealed this matter to the Supreme Court of Texas, case no. 04-0228. The Texas Supreme Court affirmed the dismissal on May 28, 2004.
