Donald G. MacPhail v. Comm'n for Lawyer Discip
On November 9, 2012, the Board of Disciplinary Appeals dismissed for want of prosecution the appeals of Abilene attorney Donald G. MacPhail, 45, State Bar of Texas Card No.00788757, from five judgments signed on August 3, 2011by the Evidentiary Panel for the State Bar of Texas District 14 grievance committee in Case Nos. D0031039748, four-year active suspension, (BODA no. 49459); D0110938842, a disbarment, (BODA no. 49514); D0021039435, one - year active suspension, (BODA no. 49515); D0041039871, seven year active suspension, (BODA no. 49516); D0071040718, a disbarment (BODA no. 49517). MacPhail did not file a brief in any of the cases and the Board issued Orders to Show Cause in both appeals to MacPhail on April 2, 2012 and August 6, 2012, the last Show Cause gave him 30 days to respond and show cause as to why the appeals should not be dismissed for want of prosecution. MacPhail did not respond. MacPhail appealed all five matters to the Supreme Court of Texas; cause nos. 12-1023, 12-1024, 12-1025, 12-1026 and 12-1027. All five were dismissed for want of prosecution on September 20, 2013.
