Garry S. Smith v. LESLIE A. J. SACHANOWICZ and Comm'n for Lawyer Discipline

On March 7, 2002, the Board of Disciplinary Appeals reversed an order dismissing a complaint filed by Garry S. Smith against San Antonio attorney Leslie A.J. Sachanowicz, 34, State Bar Card No. 17503200. The evidentiary panel for the State Bar of Texas District 10A grievance committee dismissed the complaint against Sachanowicz on August 13, 2001, in case no. S0090008662. The dismissal was appealed to BODA by the complainant below. The State Bar Chief Disciplinary Counsel's office originally filed an appeal from the dismissal but later withdrew that appeal. The Board reversed the panel's findings that the charge against Sachanowicz contained a fatal technical defect and that it failed to fairly notify the respondent of the charges pending against him. The Board remanded the cause for a new evidentiary hearing before a panel consisting of members who have not previously participated in the matter at any stage. Sachanowicz appealed the decision of the Board of Disciplinary Appeals to the Texas Supreme Court, case number 02-0273. On October 10, 2002, the Texas Supreme Court affirmed the reversal by BODA.
