In re ALTON W. PAYNE

On April 13, 2010, the Board of Disciplinary Appeals revoked the probation of Dallas attorney Alton W. Payne, State Bar of Texas Card No. 15649450, and suspended him from the practice of law for 22 months, beginning April 13, 2010 and ending February 13, 2012. On or about November 25, 2008, Payne signed a corrected agreed judgment of partially probated suspension that was also signed by the District 04B3 State Bar of Texas grievance committee. The agreed judgment stipulated that Payne committed professional misconduct by violating TEXAS DISCIPLINARY RULES OF PROFESSIONAL CONDUCT 1.01(b)(1), 1.15(d), 1.03(a), 8.04(a)(3), and 8.04(a)(8) and suspended him from the practice of law for 24 months with the last 22 months of the suspension, beginning March 1, 2009 and ending on December 31, 2010, probated on certain terms and conditions. The Board of Disciplinary Appeals found that Payne materially violated the terms and conditions of corrected agreed judgment of suspension. Payne has appealed the revocation to the Supreme Court of Texas (cause number 10-0303). The Court dismissed his appeal upon his motion on July 30, 2010.
